The terms “we”, “us” and “our” refer to JVBTOOLS.

We operate this website and online store. Our store is powered by Shopify, which provides the ecommerce platform that allows us to offer and sell our products to you.

These Terms of Service apply when you visit our website, use our services or purchase products from us.

By using our website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Return and Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

SECTION 2. USE OF OUR WEBSITE

You may use our website only for lawful purposes.

You must not use our website in a way that could damage, disable or interfere with the website, our systems or the experience of other users.

You must not attempt to gain unauthorized access to our website, customer accounts, systems or data.

If you create an account, you are responsible for keeping your login details secure and for the activity performed through your account.

SECTION 3. OUR PRODUCTS

We make reasonable efforts to display our products, product descriptions, dimensions, colors and images as accurately as possible.

Colors may appear slightly different depending on your screen, device and display settings.

Product dimensions may have small manufacturing tolerances where this is reasonable for the type of product.

We may update product descriptions, designs, packaging or availability from time to time.

Nothing in this section affects your statutory rights if a product is defective, damaged or materially different from its description.

SECTION 4. STICKERS AND APPLICATION

Many products sold by JVBTOOLS are adhesive stickers.

Before applying a sticker, you are responsible for checking whether the sticker is suitable for the intended surface.

Surfaces should generally be clean, dry and free from grease, dust and other contamination before application.

We recommend testing suitability before applying a sticker to sensitive, painted, coated or valuable surfaces.

We are not responsible for damage caused solely by incorrect installation, incorrect removal, application to an unsuitable surface or use contrary to the product information we provide.

This does not limit your statutory rights where damage is caused by a defective product or where liability cannot legally be excluded.

SECTION 5. ORDERS

When you place an order, you make an offer to purchase the products in your order.

An order is accepted when we confirm the order or otherwise confirm that we have accepted it.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, obvious pricing errors, payment problems, stock errors or incorrect customer information.

If we cancel an order after payment has been received, the relevant amount will be refunded.

Please check your order carefully before completing your purchase.

If you notice an error after ordering, contact us as soon as possible at jvbtools01@gmail.com. We cannot guarantee that an order can be changed or cancelled once processing has started.

SECTION 6. PRICES AND PAYMENT

The price charged is the price displayed and confirmed at checkout at the time you place your order.

Prices shown to consumers include applicable VAT where required by law, unless clearly stated otherwise.

Shipping charges and other applicable costs will be displayed or explained before you complete your purchase.

For deliveries outside the European Union, local customs duties, import taxes or other charges may apply.

Unless we expressly state otherwise, these charges are not included in our prices and may be charged by the authorities or delivery provider in the destination country.

You are responsible for providing accurate billing, shipping and payment information.

SECTION 7. SHIPPING AND DELIVERY

We aim to process and ship orders within the timeframes stated on our website.

Delivery dates and delivery estimates are estimates unless we have expressly agreed on a specific guaranteed delivery date.

Delays can occur due to postal carriers, customs, public holidays, weather conditions or other circumstances outside our reasonable control.

For consumer orders, responsibility for the goods remains with us until you, or a person designated by you, physically receives the goods, except where you independently arranged a carrier that was not offered by us.

If your order has not arrived within the expected timeframe, please contact us so we can investigate the shipment.

SECTION 8. RIGHT OF WITHDRAWAL FOR EU CONSUMERS

If you are a consumer located in the European Union, you generally have the legal right to withdraw from an online purchase within 14 days after receiving the goods, without giving a reason.

To exercise this right, you must inform us of your decision within the applicable withdrawal period.

After informing us of your withdrawal, you must return the applicable products within the legally required timeframe.

The direct cost of returning products under the right of withdrawal is your responsibility, unless applicable law requires otherwise or we have agreed to pay these costs.

SECTION 9. USED STICKERS AND DIMINISHED VALUE

You may inspect a product to determine its nature, characteristics and functioning in a way similar to what would reasonably be possible in a physical store.

You are responsible for any diminished value resulting from handling or using a product beyond what is necessary to inspect it.

A sticker that has been applied, attached to a surface, removed after application, modified or otherwise used may no longer be suitable for resale.

If this causes a reduction in value, we may deduct the legally permitted amount of that reduction in value from your refund.

For a sticker that has been applied and can no longer be resold, the reduction in value may amount to the full value of that sticker.

This provision does not apply where the product was defective, damaged or incorrect when delivered.

SECTION 10. CUSTOM AND PERSONALIZED PRODUCTS

The statutory right of withdrawal does not apply where an applicable legal exception applies to products made according to your specifications or products that are clearly personalized.

This may include stickers produced specifically for you with custom names, text, dimensions, artwork or other personalized specifications.

Your statutory rights relating to defective, damaged or incorrectly supplied products continue to apply.

SECTION 11. RETURNS AND EXCHANGES

We do not offer a voluntary exchange service.

Where you have a statutory right to return a product, you may return it in accordance with our Return and Refund Policy.

If you want a different product, you may place a new order separately.

SECTION 12. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Please inspect your order after receiving it.

If you receive an incorrect, damaged or defective product, please contact us at jvbtools01@gmail.com.

Please provide your order number and, where relevant, photographs showing the issue.

If a product does not conform to the sales contract, you have the remedies provided by applicable consumer law.

Depending on the circumstances and applicable law, this may include repair, replacement, a price reduction or refund.

Nothing in these Terms limits your statutory legal guarantee rights.

SECTION 13. REFUNDS

Refunds are handled in accordance with our Return and Refund Policy and applicable consumer law.

Where a valid statutory withdrawal applies, we will refund the payments that must legally be refunded.

We may withhold reimbursement until we have received the returned goods or until you have provided evidence that the goods have been returned, where permitted by law.

Refunds will normally be made using the original payment method unless otherwise agreed.

Processing times of banks and payment providers are outside our control.

SECTION 14. PROMOTIONS AND DISCOUNT CODES

From time to time we may offer discounts, promotional codes or special offers.

Additional conditions may apply to a promotion.

Promotional codes cannot be exchanged for cash unless required by law.

We may refuse or cancel the use of promotional codes in cases of fraud, misuse or obvious technical errors.

If specific promotional conditions conflict with these Terms, the specific promotional conditions will apply to that promotion, subject to mandatory law.

SECTION 15. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of our website, including our branding, logos, product photography, graphics, text, videos, product designs and other original material, is owned by JVBTOOLS or used by us with permission.

You may use the website for personal and noncommercial purposes.

You may not copy, reproduce, distribute, sell, modify or commercially exploit our protected content without our prior permission or another valid legal basis.

Third party names, logos and trademarks remain the property of their respective owners.

References to third party brands are not intended to imply sponsorship, partnership or endorsement unless explicitly stated.

If you submit a review, photograph, comment, suggestion or other content to us, you confirm that you have the right to submit that content.

You must not submit unlawful, misleading, defamatory, infringing or harmful content.

Where you voluntarily submit content for publication or promotional purposes, you grant us a nonexclusive, worldwide and royalty free right to use, reproduce and display that content in connection with our website, products and marketing, to the extent permitted by law.

This does not transfer ownership of your content to us.

We may remove content from our website where we reasonably believe it violates these Terms or applicable law.

Our website may contain services, integrations or links provided by third parties.

This may include payment providers, shipping providers, social media platforms and other websites.

Our online store is hosted by Shopify.

Shopify provides the ecommerce technology that enables us to operate the store.

Purchases made through our store are made between you and JVBTOOLS.

Shopify is not the seller of JVBTOOLS products.

We process personal information in accordance with our Privacy Policy and applicable data protection law.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers that are required to operate the store.

We make reasonable efforts to keep the website and product information accurate and available.

We do not guarantee that our website will always be available without interruptions or technical errors.

Occasionally our website may contain typographical errors, incorrect prices, inaccurate stock information or other mistakes.

We may correct obvious errors and update information.

If an error materially affects an order you have already placed, we will contact you where appropriate.

Nothing in this section limits rights that you have under mandatory consumer law.

We are not responsible for delays or failures caused by events outside our reasonable control where permitted by applicable law.

Such events may include major disruptions to postal services, transport networks, natural disasters, war, government measures, widespread technical failures or other comparable circumstances.

Where such an event affects an order, we will take reasonable steps to limit the impact and fulfil our obligations as soon as reasonably possible.

Your statutory rights remain unaffected.

SECTION 24. TERMINATION AND SUSPENSION

We may suspend or terminate access to our website where you seriously or repeatedly violate these Terms, misuse our website, commit fraud or threaten the security of our services.

Termination of access to the website does not remove rights or obligations that arose before termination.

Consumer rights relating to an existing purchase remain unaffected.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The invalid provision will apply only to the maximum extent permitted by applicable law.

These Terms and contracts concluded with JVBTOOLS are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence where those protections cannot legally be excluded.

Any dispute will be handled by a court that has jurisdiction under applicable law.

Nothing in this section limits any statutory right you may have to bring proceedings in another competent court.
